Licking County Probate Court

The Licking County Probate Court is at 1 N. Park Place, 1st Floor, Newark, Ohio 43055. Phone: (740) 670-5624. The online application must be submitted at least 24 hours before your appointment. You can access it through the Licking County Probate Court website. Print the confirmation page and bring it with you. Both people must show up at the courthouse together.

What You Need

The application asks for your full name, Social Security number, current address, phone number, birthplace (city and state), date of birth, occupation, and your parents' first, middle, and last names as shown on the birth certificate (including maiden names). You must name the person who will perform the ceremony, if known.

If you were previously married, the court needs a certified copy of the most recent divorce or dissolution decree. Widowed applicants must provide the full name and date of death of the deceased spouse along with a death certificate. These details are all required under ORC 3101.05.

At least one applicant must be a Licking County resident, or both must be from out of state and planning to marry in Licking County. You must be 18 or older. If you are under 18, contact the court about additional requirements.

Fees and Payment

The marriage license fee is $70.00. Cash, credit, and debit are accepted. Checks are not. This is one of the higher fees in Ohio, where most counties charge $50. The fee is paid when you complete the in-person part of the application.

Certified copies of marriage records cost $2.00 each. You can pay with cash, check, credit, or debit for copies. To request copies, provide the names of both parties (as they were before the marriage) and the date of marriage. For licenses issued before 1991, the court needs the exact date of marriage to find the record.

If you are not sure which county or date a marriage was recorded, call the Ohio Vital Statistics office at 614-466-2531. They maintain a statewide index from September 1949.

Marriage Record History

Licking County has marriage certificates from 1875 to the present. A fire in 1875 destroyed many early court records, though some survived. For official certified copies, contact the Probate Court at (740) 670-5624.

Under ORC 149.43, marriage records are public. Anyone can request to see them. Social Security numbers are removed first.

The Licking County Health Department at 675 Price Road, Newark, handles birth and death records but does not deal with marriage records. That is exclusively the Probate Court's role.

Copies cost $2.00 each. For records before 1991, you need the exact marriage date because the indexing system changed at that point. If you are not sure of the date, call (740) 670-5624 and the staff can try to look it up for you.

The 1875 courthouse fire destroyed some early records, but marriages that survived that event are still on file. Later records from the 1900s onward are more complete, with birthplaces, parents' names, and occupations. If you are doing family research in Licking County, the Records and Archives Center is worth checking for older probate files that may include marriage-related documents like affidavits and consent records for minors.

Officiants for the Ceremony

ORC 3101.08 lists who can legally marry you. Ordained or licensed ministers registered with the Ohio Secretary of State, county and municipal court judges, probate judges under ORC 2101.27, and mayors of any Ohio municipality all qualify. Religious societies can also conduct ceremonies under their own rules.

The officiant must file the signed certificate with the Licking County Probate Court within 30 days. A return envelope is provided. Missing the deadline is a minor misdemeanor with a $50 fine under ORC 3101.14.
