Fairfield County Overview
Fairfield County Probate Court
The Fairfield County Juvenile/Probate Court is at 224 E. Main Street, Room 308, Lancaster, OH 43130. Phone: (740) 652-7485. The office is open Monday through Friday, 8:00 a.m. to 4:00 p.m. Judge Terre L. Vandervoort presides over the court. Marriage licenses are issued by appointment only, so you will need to call ahead or use the online system to set up your visit. The court accepts both in-person and virtual appointments.
Before your appointment, you must fill out the online marriage application on the court's website. The application is good for 30 days. If you don't come in within that window, you'll have to fill it out again. This pre-application step saves time at the courthouse since the clerk already has your information when you arrive.
The Fairfield County Probate Court website details the full marriage license application process and appointment system.
The court's site walks you through each step, from the online pre-application to what you need to bring on your appointment day.
Marriage License Requirements
Both applicants must appear together. Each person needs a valid photo ID. The court accepts a driver's license, state ID card, passport, or military ID. If your ID does not show your current address, bring proof of residency such as a utility bill or bank statement. You also need your Social Security number for the application, though it will not appear on the license under ORC 3101.05.
If either person is 18 or under, a certified birth certificate is required. People 19 and older do not need to show proof of age beyond their photo ID. Anyone who was married before must bring a certified or file-stamped copy of the most recent divorce or dissolution decree. Non-U.S. citizens need a passport or resident alien card. If you have had a legal name change, bring the certified copy of the judgment entry.
Fairfield County Marriage License Fees
The marriage license fee in Fairfield County is $65.00 if you pay with cash or money order. Credit card payments cost $67.00 because of a $2.00 processing fee. Certified copies of the marriage certificate are $2.00 each. The court accepts cash, check, money order, and credit cards. You can also pay by phone with a credit card by calling (740) 652-7485.
It makes sense to get several certified copies at the same time. You will likely need them for name changes at the BMV, Social Security Administration, your bank, and possibly your insurance company. Each copy is only $2.00, so getting four or five adds very little to the total cost.
Ceremony and Filing Rules
The Fairfield County Probate Court does not perform wedding ceremonies. You will need to find your own officiant. Under ORC 3101.08, authorized officiants include ordained or licensed ministers, judges, probate judges, mayors, and religious societies acting under their own church rules. The Ohio Secretary of State keeps a list of ministers registered to perform weddings in the state.
After the ceremony, the officiant must sign the marriage certificate and send it to the Fairfield County Probate Court within 30 days. This is the law under ORC 3101.13. If it's not returned in time, there is a $50 fine. Once the court receives the signed certificate, the marriage is on the official record and certified copies can be ordered. The license itself is only good for 60 days from the date of issuance per ORC 3101.07.
Fairfield County Records Access
Marriage license records in Fairfield County are public records under ORC 149.43. The court has an online probate records search tool where you can look up records without visiting in person. For older records or genealogy purposes, the Ohio Department of Health maintains a statewide marriage index from September 1949 to the present. Records before that date require a direct search at the Probate Court or through the Ohio History Connection.
The Fairfield County Health Department handles birth and death certificates but does not handle marriage records. If you call them about a marriage certificate, they will point you to the Probate Court. The Ohio Legal Help website also has a directory page for the Fairfield County court with contact information and links to free legal clinics.
The Fairfield County Health Department site confirms that marriage certificates must be obtained from the Probate Court, not the health department.
The court also offers free virtual legal clinics on the fourth Tuesday of every month from 5:00 to 7:00 p.m. You can register by calling 844-302-1800. These clinics can help with questions about marriage licenses, name changes, and other probate matters.
Cities in Fairfield County
Residents of Lancaster and other cities in Fairfield County all go to the same Probate Court in Lancaster for marriage licenses. No city office in the county can issue a marriage license. The Probate Court is the only option. If you live in a smaller town in the county like Amanda, Baltimore, or Rushville, you still apply at the Lancaster courthouse.
The Fairfield County Clerk of Courts handles divorce and dissolution records but does not issue marriage licenses. If you need a divorce decree to bring to your marriage license appointment, contact the Clerk of Courts office. The Fairfield County Domestic Relations Court processes those records. Keep the two offices straight so you go to the right place for each type of document. The marriage license goes through the Probate Court, and divorce records go through the Clerk of Courts.
