Defiance County Probate Court

You and your partner must both show up in person to apply for the license. This is a core rule under ORC 3101.05. Each person fills out the application and gives their information under oath. No one else can do this on your behalf.

What You Need for the Application

Each person needs to bring valid photo ID. A driver's license or state ID will do. A passport works too. You must provide your Social Security number on the application. The form asks for name, age, residence, place of birth, occupation, father's name, and mother's maiden name. If you know who will perform the ceremony, include their name as well.

Anyone who was married before needs to bring proof of how that marriage ended. A certified copy of the divorce decree is required. If a former spouse died, the death certificate takes its place. You must list prior spouses and any minor children from those marriages. Ohio law takes this seriously. Making false statements on the application is falsification under ORC 2921.13, which is a criminal charge.

Note: Defiance County sits near the Indiana border. If you were divorced in Indiana or another state, you still need that out-of-state divorce decree to apply here.

Marriage License Cost and Validity

The fee is about $50. Call the court at (419) 782-4181 to confirm the current fee and accepted payment methods. Ohio does not have a waiting period. You can apply and get the license on the same visit. There is no blood test requirement.

A marriage license in Ohio stays valid for 60 days from the date it is issued. This is per ORC 3101.07. The 60-day limit is printed on every license in bold type so there is no confusion. If the wedding does not happen in time, the license expires. You would have to start over.

Ceremony Requirements

Ohio has a specific list of people who can legally perform a marriage ceremony. ORC 3101.08 includes ordained ministers registered with the Ohio Secretary of State, county and municipal court judges, probate judges, mayors, and religious societies following their own rules. The governor or any former governor can also officiate.

After the wedding, the officiant must sign the marriage certificate and return it to the Defiance County Probate Court within 30 days. This is not optional. ORC 3101.13 makes it a legal requirement. A pre-addressed envelope comes with each license. If the certificate is not filed in time, the officiant faces a minor misdemeanor and a $50 fine.

Note: The Ohio Department of Health has a statewide index but does not issue certified copies of marriage records. Only the county probate court can do that.

Age Rules and Other Restrictions

Both applicants must be at least 18 years old. If one person is 17, the process is more involved. Under ORC 3101.02, a 17-year-old needs consent from a juvenile court. The other person cannot be more than four years older. The juvenile court must determine that the decision is free from force, that the marriage is in the best interests of the parties, and that the minor is either in the armed services or self-supporting.

The court will refuse to issue a license if either person appears to be under the influence of alcohol or drugs, per ORC 3101.06. This is a straightforward rule that applies in every Ohio county.
