Geauga County Probate Court

The court handles marriage license applications, estates, guardianships, and other probate matters. Marriage License Requirements

Both applicants must come to the courthouse together in person. Under ORC 3101.05, you apply in the county where either person lives. If neither lives in Ohio, you apply in the county where the ceremony will happen. Each person needs a valid photo ID such as a driver's license, state ID, passport, or military ID. You also need your Social Security number for the application, though it will not appear on the license.

The application asks for name, age, residence, place of birth, occupation, father's name, mother's maiden name, and the name of the officiant. If either person has been married before, you must bring a certified copy of the most recent divorce decree and list any minor children from previous marriages. Applicants must be at least 18. For 17-year-olds, juvenile court consent is required, followed by a 14-day waiting period.

Geauga County has a large Amish community. Religious societies can perform marriage ceremonies under their own church rules, as authorized by ORC 3101.08.

Fees and Certified Copies

The marriage license fee in Geauga County is about $50. Contact the court at (440) 279-1840 to confirm the current fee and accepted payment methods. Certified copies of the marriage certificate are available for a small per-copy charge. Order several copies at once. You may need them for the BMV, Social Security, your bank, and insurance. Each agency usually wants its own original certified copy.

There is no waiting period and no blood test. The license is good for 60 days from the date it is issued, as set by ORC 3101.07. If you don't use it within that window, you'll have to apply again.

The archives have marriage licenses from 1825 to 1919 in book index and microfilm format, and marriage records from 1806 to 1919 in the same format. Records after 1919 are kept at the Probate Court. For records from September 1949 forward, the Ohio Department of Health has a statewide index that can help locate which county holds a specific record. The Ohio History Connection is another resource for older marriage records from various Ohio counties. All marriage records in the county are public under ORC 149.43.

Ceremony and Filing

Under ORC 3101.08, authorized officiants include ordained or licensed ministers registered with the Ohio Secretary of State, county and municipal court judges, probate judges (under ORC 2101.27), mayors, and the superintendent of Ohio deaf and blind education services. Religious societies may also perform ceremonies in line with their own traditions.

The officiant must sign the certificate and return it to the Geauga County Probate Court within 30 days of the ceremony. That is the law under ORC 3101.13. A $50 fine applies if the certificate is not returned on time. Once the court has the signed certificate, the marriage is on the official record and certified copies can be ordered.
