Lake County Probate Court

The Lake County Probate Court is at 25 North Park Place in Painesville, OH 44077. The Marriage Department can be reached at (440) 350-2326 or (440) 350-2168. The main court line is (440) 350-2657. Hours are Monday through Friday, 8:00 a.m. to 4:30 p.m. Judge Mark J. Bartolotta presides over the court, with Christine Gibaldi serving as Court Administrator and Chief Deputy Clerk.

Marriage license applications in Lake County are done by appointment only. You apply online first and then schedule a time to visit the court. Contact Teresa Corbin in the Marriage Department to set up your appointment. You can also email the department at marriagedepartment@lakecountyohio.gov if you have questions before you apply. Both applicants must be there in person, per ORC 3101.05.

Note: Walk-ins are not accepted for marriage license applications in Lake County. You must apply online and schedule an appointment first.

What to Bring

Each applicant needs a valid photo ID. Driver's license, state ID, or passport all work. You also need your Social Security number. Bring the card itself or a document that shows the number, like a W-2 or tax form. Your Social Security number will not appear on the public marriage record. ORC 3101.051 requires the court to remove it before making the record available.

Were you married before? You must bring a certified copy of every divorce decree. Each one. The court needs the date, case number, and jurisdiction for each past divorce. If your former spouse died, bring the death certificate. You must also provide your full name, age, place of birth, occupation, and parents' names including the mother's maiden name. All of this goes on the sworn application.

License Fees and Validity

The marriage license fee in Lake County is around $50. Contact the Marriage Department to confirm the exact amount and payment methods. You pay when you complete the application at your appointment. No extra charges apply for the license itself.

Ohio has no waiting period. The state dropped its old five-day wait in 2001. Once you pay, the license is active right away. It remains valid for 60 days from the date of issue, per ORC 3101.07. After that, it expires. The expiration date is printed on the license in clear type. You can use the license anywhere in Ohio, not just in Lake County. If the 60 days pass with no ceremony, you start over.

Marriage records in Lake County are public under ORC 149.43. Anyone can request copies during regular business hours. The court must provide them at a reasonable cost. Social Security numbers are stripped out before the records go to the public. For certified copies of a marriage record, visit the Probate Court in person or send a mail request. Have the names of both parties and the approximate date of marriage ready. The more details you provide, the faster the search. The Lake County Clerk of Courts handles divorce records separately and does not issue marriage licenses.

The Ohio Department of Health maintains a statewide marriage index from September 7, 1949, to the present. It covers all 88 counties. But certified copies still come from the Lake County Probate Court. The statewide index is useful when you do not know which county a marriage took place in.

Who Can Perform the Ceremony

Under ORC 3101.08, authorized officiants include ordained or licensed ministers registered with the Ohio Secretary of State, county and municipal court judges, probate judges, and mayors of any Ohio city. Religious societies may also perform ceremonies under their own rules. The probate judge in Lake County can officiate under ORC 2101.27, with any fee going to the county treasury.

The officiant must return the signed marriage certificate to the Lake County Probate Court within 30 days. That is the rule under ORC 3101.13. Failure to file on time is a minor misdemeanor with up to a $50 fine. The court provides an envelope with each license for this purpose.

Historical Records Research

Lake County was formed in 1840. Marriage records go back to that date. Early records tend to be sparse, listing only names and the date of the ceremony. Later records include more detail. For genealogy research, the Ohio History Connection may hold some older Lake County records. There is no statewide index to marriages before September 7, 1949. If you are searching for a Lake County marriage before that date, you need to contact the Probate Court directly or check census records for clues about where the couple was living around the time of the marriage.
