Jefferson County Probate Court

The Jefferson County Probate Court is at 301 Market Street in Steubenville, OH 43952. Call them at (740) 283-8593 during business hours. This is the only office in the county that can issue a marriage license or give out certified copies of marriage records. The court also handles estate cases, guardianships, and adoptions. Walk-in visits work during regular hours, and staff can help you with forms and questions when you get there.

Both people who want the license must show up in person. That is a hard rule under ORC 3101.05. At least one of you must be a Jefferson County resident, or you can both be from out of state as long as the wedding takes place in the county. This rule applies to all 88 Ohio counties. You cannot send someone else in your place or do the whole thing by mail.

The court keeps genealogy records too. Biographies, birth records, cemetery burial lists, military records, newspaper data, and obituaries are all on file. These extra records can be a big help if you are working on family history in Jefferson County.

Marriage License Requirements

Each person must bring a valid photo ID. A driver's license, state-issued ID card, or passport will work. You also need your Social Security number. The court will accept your Social Security card, a W-2 form, or a tax return that shows the number. Under ORC 3101.051, Social Security numbers are stripped from the public record before anyone can view it. That keeps your personal data safe.

If you were married before, bring the final divorce decree for each past marriage. Not just the last one. Every single one. The court needs dates, case numbers, and which court granted the divorce. If your former spouse died, bring the death certificate instead. Giving false information on a marriage license application is a criminal offense under ORC 2921.13, so be honest and thorough on every question.

Fees and Timing

The marriage license fee in Jefferson County is around $50. Cash and money orders are accepted. Check with the court about debit and credit card options before you go. You pay this fee at the time you file your application. There are no hidden charges for the license itself.

Ohio got rid of its waiting period back in 2001. That means your license is valid right away once you pay. It stays good for 60 days from the date it was issued, per ORC 3101.07. The expiration date is printed on the license. If 60 days pass without a ceremony, you need to start over with a new application and a new fee. The license can be used anywhere in the state of Ohio, not just in Jefferson County.

Ohio law spells out who can perform a wedding. ORC 3101.08 names ordained or licensed ministers who are registered with the Ohio Secretary of State, judges of county or municipal courts, probate judges, and mayors of any Ohio city. Religious groups may also conduct ceremonies under their own rules.

After the wedding, the officiant must file the signed marriage certificate with the Jefferson County Probate Court within 30 days. That is set out in ORC 3101.13. Missing this deadline is a minor misdemeanor. The court hands out a pre-addressed envelope with each license so there is no excuse for a late return. Once the certificate is filed, the marriage becomes part of the county's official records.

Marriage records in Jefferson County are public. ORC 149.43 gives anyone the right to view and copy public records during regular business hours. The court must respond to requests in a reasonable time. Social Security numbers are always removed first. You can request records in person, by phone, or by mail.

The Jefferson County Probate Court has marriage records going back to 1797. Early records may show only names and dates. This index covers all 88 Ohio counties. But it is only an index. Certified copies still come from the Jefferson County Probate Court.
