Mahoning County Probate Court

The Mahoning County Probate Court is at 120 Market Street, First Floor, Youngstown, OH 44503. Phone: (330) 740-2324. Fax: (330) 740-2325. Hours are 8:00 a.m. to 4:00 p.m. Monday through Friday. The court manages marriage licenses, estate records, guardianships, and adoptions. It is the only office in the county that can issue a marriage license.

Both applicants must appear in person. There are no exceptions. ORC 3101.05 requires each person to show up at the probate court and fill out the application under oath. At least one applicant must live in Mahoning County. If both are from out of state, the wedding must take place in the county where the license was issued.

The court also provides certified copies of existing marriage records. Historical records are available from the county's formation in 1846.

Marriage License Requirements

Bring a valid photo ID for each person. Driver's license, state-issued ID, or passport will all work. You also need proof of your Social Security number. A Social Security card, W-2, or tax document will do. Under ORC 3101.051, Social Security numbers are removed from the public marriage record before anyone else can view the file.

If you were married before, you need a certified copy of every divorce decree. Not just the most recent. All of them. The court needs dates, case numbers, and which court granted each divorce. If a former spouse died, bring the death certificate. You must also state your name, age, residence, place of birth, occupation, and parents' names including the mother's maiden name. Giving false information is a criminal offense under ORC 2921.13.

Note: Mahoning County was formed from Columbiana and Trumbull counties in 1846. Marriage records from before 1846 are held by those parent counties, not by Mahoning County.

Fees and License Duration

The fee for a marriage license in Mahoning County is around $50. Call the Probate Court at (330) 740-2324 to confirm the exact amount and accepted payment methods. You pay when you complete the in-person application. No extra charges for the license itself.

Ohio dropped its waiting period in 2001. Your license is good right away. It stays valid for 60 days from the date of issue, per ORC 3101.07. The expiration date is printed right on the license. After 60 days it expires and you need to start over. The license can be used anywhere in the state of Ohio, not just in Mahoning County.

Marriage records are public under ORC 149.43. Anyone can request copies during business hours. Social Security numbers are stripped out before records are released. The court must respond to requests within a reasonable time and at a reasonable cost.

The Youngstown City Health District issues birth certificates (since 1909) and death certificates (since 1892) for all of Mahoning County. The Ohio Department of Health maintains a statewide index to marriage records from September 7, 1949, forward. This index covers all 88 Ohio counties. Certified copies still must come from the Mahoning County Probate Court. The statewide index is useful when you are unsure which county a marriage took place in.

Officiants in Mahoning County

Under ORC 3101.08, people who can officiate a wedding include ordained or licensed ministers registered with the Ohio Secretary of State, county and municipal court judges, probate judges, and mayors. Religious societies may conduct ceremonies under their own rules. The Mahoning County probate judge can also perform ceremonies under ORC 2101.27.

After the ceremony, the officiant must file the signed marriage certificate with the Mahoning County Probate Court within 30 days. ORC 3101.13 requires this. Late filing is a minor misdemeanor. The court provides a pre-addressed envelope with each license. Once filed, the marriage certificate becomes part of the county's permanent records and is consecutively numbered.

Genealogy researchers should note the 1846 formation date. Any marriage that took place in the area before 1846 would be recorded in either Columbiana County or Trumbull County. The Ohio History Connection notes this pattern and recommends checking parent counties for pre-formation records. Marriage records before 1899 typically do not include parents' names.
