Ottawa County Probate Court

The Ottawa County Probate Court is on the second floor of the courthouse at 315 Madison Street in Port Clinton, Ohio 43452. Call (419) 734-6830 to reach them. The office is open Monday through Friday, 8:30 a.m. to 4:00 p.m. This is the only place in Ottawa County where you can apply for a marriage license or get a certified copy of a marriage record.

Both people must come to the court in person. ORC 3101.05 makes this a strict rule that cannot be waived. At least one of you must live in Ottawa County, unless neither person is an Ohio resident. In that case, you can still get a license here, but the ceremony must happen within Ottawa County. Port Clinton is a popular spot for weddings given the Lake Erie waterfront, so non-residents do apply here from time to time.

Bring a valid photo ID. The court accepts a driver's license, state ID, or passport. You will also need proof of your Social Security number. The number itself is kept private on the public record. Under ORC 3101.051, probate courts must remove Social Security numbers before letting anyone view marriage license files.

Note: Ottawa County sees more license applications during summer months. Call ahead if you plan to visit between May and September.

Application Requirements

The marriage license application asks for details from both parties. Each person states under oath their name, age, residence, place of birth, occupation, and parents' names. The mother's maiden name is needed if known. You must also name the person who will perform the wedding. All of these requirements come from ORC 3101.05.

If you were married before, extra paperwork is required. You need a certified copy of the final divorce decree for every past marriage. Not just the last one. Every single one. The application must include the names of former spouses, any minor children, and the jurisdiction, date, and case number for each divorce. If a prior spouse passed away, bring the death certificate. Lying on the application is falsification under ORC 2921.13, which is a criminal charge. The court takes this seriously.

Fees and License Duration

Contact the Ottawa County Probate Court at (419) 734-6830 to confirm the current fee. Most Ohio counties charge around $50 for a marriage license, though fees can vary. Ask about accepted payment methods when you call, as some probate courts take only cash while others accept cards or money orders.

Ohio has no waiting period for marriage licenses. That has been the case since 2001, when the old five-day wait was eliminated. Your Ottawa County marriage license is good for 60 days from the issue date. ORC 3101.07 sets this time limit, and the expiration date is printed right on the license. If your wedding does not happen within that 60-day window, the license expires and you would need to start over with a new application and fee.

Ceremony and Filing

ORC 3101.08 lists who can perform a wedding in Ohio. The list includes ordained or licensed ministers registered with the Secretary of State, judges, probate judges, and mayors of any Ohio municipality. Religious organizations may also perform ceremonies in line with their own rules and traditions.

The officiant has a job to do after the ceremony, too. They must sign the marriage certificate and return it to the Ottawa County Probate Court within 30 days. That is the law under ORC 3101.13. Missing that deadline is a minor misdemeanor. The court hands out a pre-addressed envelope with each license so the return is easy. Until that signed certificate comes back, the marriage is not officially on record.

If the probate judge performs your ceremony, there may be a separate fee for that service. Under ORC 2101.27, probate judges can charge a reasonable fee for solemnizing marriages, and the full amount goes to the county treasury.

Ottawa County Marriage Records

Marriage records in Ottawa County are public. ORC 149.43 gives anyone the right to request and view these records during normal business hours. You do not need to explain your reason. The court must provide copies at a reasonable cost and within a reasonable time. Social Security numbers are always removed before the records are shared.
