Shelby County Probate Court Details

Both applicants must appear in person at the courthouse. ORC 3101.05 requires each person to show up and fill out the application under oath. This cannot be done by phone, mail, or online. One of you needs to live in Shelby County, unless neither person is an Ohio resident and the ceremony will take place in the county.

The court was established in 1851. Marriage records here go back even further to 1824, before the court was formally set up. That long history means researchers can find records spanning nearly 200 years. Parents' names started appearing in records around 1900, which is helpful for genealogy work.

What You Need to Bring

Each person needs a valid photo ID such as a driver's license, state ID, or passport. You will also need to provide your Social Security number. The court collects it on the application, but ORC 3101.051 requires that it be removed from the record before public access is allowed. So your number stays confidential even though you have to give it.

If you were married before, bring a certified copy of the most recent divorce decree. Include the case number, date, and jurisdiction. Widowed applicants need to bring a death certificate. Providing false or incomplete information on the application is falsification under ORC 2921.13. The court checks these details carefully.

Ohio has no waiting period. That changed in 2001 when the five-day wait was eliminated. Your license is valid the moment you pay and the judge approves it. Ceremony and Filing

Ohio law lists the people who can perform a wedding. Under ORC 3101.08, authorized officiants include ordained or licensed ministers registered with the Secretary of State, county and municipal court judges, probate judges under ORC 2101.27, and mayors of any Ohio city. Religious groups can also conduct ceremonies following their own traditions.

After the ceremony, the officiant must return the signed marriage certificate to the Shelby County Probate Court within 30 days. This is required by ORC 3101.13. The court gives you a pre-addressed envelope with the license. If the certificate is not returned on time, the officiant can be fined up to $50 for a minor misdemeanor.
