Hamilton County Probate Court in Cincinnati

The Hamilton County Probate Court is at 230 East Ninth Street, 10th Floor, Cincinnati, OH 45202. The phone number is (513) 946-3589 and the fax is (513) 946-3577. Office hours run Monday through Friday, 8:00 AM to 3:45 PM. The court will not start new transactions after 3:45, so arrive well before then. The whole application process takes about 20 to 25 minutes at the window.

A pre-application is available on the court's website. Filling it out ahead of time saves a good chunk of wait. Both parties must still show up together, as ORC 3101.05 requires each person to personally appear. There are limited exceptions for illness or disability, but for most couples, an in-person visit is the only way.

The court accepts cash, credit cards, and debit cards. They do not take checks. Plan your payment method before you go.

Cincinnati Marriage License Fees

The fee is $75.00. That is on the higher end for Ohio, where most counties charge between $40 and $75. Your fee includes one certified copy of the license. Additional certified copies are $2.00 each. You can pick up extras at the Records Department on the 9th floor, Monday through Friday, 8:00 AM to 3:45 PM.

If you need copies later and do not want to come back in person, the court accepts mail requests. Send a completed application form, a self-addressed stamped envelope, and a cashier's check for $2.00 per copy. Mail orders typically take up to five business days to process. What to Bring for a Cincinnati Marriage License

Each person needs a valid photo ID. A driver's license, state ID, or passport all work. You also have to give your Social Security number on the application, but it will not appear on the finished license thanks to ORC 3101.051.

If either person was married before, the court needs a certified copy of the most recent divorce decree. Widowed applicants need a death certificate. You must list all previous marriages along with any minor children, the jurisdiction where each divorce happened, the date, and the case number. Each person also states under oath their name, age, birthplace, occupation, and the names of both parents. Making a false statement on the application is a crime under ORC 2921.13.

Both applicants have to be 18 or older. If someone is 17, juvenile court consent is needed under ORC 3101.02, and the other person cannot be more than four years older. No one under 17 can get a marriage license in Ohio.

Civil Ceremonies in Cincinnati

The Hamilton County Municipal Court offers civil wedding ceremonies through the Duty Judge. Call (513) 946-5200 to set up an appointment. You need to have your marriage license already in hand. This is a separate step from getting the license at the Probate Court.

ORC 3101.08 lists who can perform a marriage: ordained ministers registered with the Secretary of State, probate judges, municipal judges, county judges, mayors, and religious societies following their own rules. The probate judge can also solemnize marriages under ORC 2101.27, with any fee going straight to the county treasury.

Searching Cincinnati Marriage Records

Hamilton County Probate Court keeps all marriage records on file. Contact the Records Department at (513) 946-3589 to search for a specific record. The court can look up records by the names of the parties and the approximate date.

The Ohio Department of Health maintains a statewide marriage index from September 7, 1949 to the present. If you are not sure which county a marriage took place in, this index can help narrow it down. But the certified copy still has to come from the county probate court. For older records, the Ohio History Connection is a good resource. All marriage records are public under ORC 149.43.

The Cincinnati Health Department at 3101 Burnet Avenue handles birth and death certificates, but does not deal with marriage licenses at all. That is a common point of confusion.
