Butler County Probate Court in Hamilton

The Butler County Probate Court is at 101 High Street, Hamilton, OH 45011. The phone number is (513) 887-3294. Hours are Monday through Friday, 8:00 AM to 4:00 PM. The court handles marriage licenses, estate administration, guardianships, and adoptions. Since Hamilton is the county seat, the courthouse is within the city limits and easy to reach.

Butler County offers an online application that you can fill out before your visit. This cuts down on the time you spend at the window. But both people must still appear in person. That is a hard rule under ORC 3101.05. Each person states their information under oath, and the probate judge reviews the application before issuing the license.

The Butler County Clerk of Courts does not keep marriage license records. They have said so on their website: "This office does not keep records of marriage licenses. Please contact the Probate Court."

Hamilton Marriage License Fees

The fee is about $50. Each Ohio probate court sets its own fee schedule, so call (513) 887-3294 to confirm the current amount. The license is valid for 60 days from the date of issue under ORC 3101.07. There is no waiting period. No blood test is needed.

Certified copies of marriage certificates are available at the courthouse. Getting several copies up front is a good move. If you plan to change your name, the BMV, Social Security office, banks, and your employer will each need to see a certified copy. It is much easier to grab them all at once than to come back or order by mail.

What to Bring for a Hamilton Marriage License

Both people need valid photo ID. A driver's license or passport works. Social Security numbers are required on the application but are removed from the public record under ORC 3101.051. Each applicant must state under oath their name, age, residence, birthplace, occupation, and the names of both parents.

If either person was married before, bring a certified copy of the most recent divorce decree. You also need to provide the names of previous spouses, any minor children from those marriages, and the divorce details including jurisdiction, date, and case number. Widowed applicants need a death certificate. These requirements come from ORC 3101.05. Making false statements is a criminal offense under ORC 2921.13.
