Montgomery County Probate Court in Dayton

The Montgomery County Probate Court is at the Montgomery County Courts Building, 41 N. Perry Street, 2nd Floor, Dayton, OH 45402. The phone number is (937) 225-4640 and the fax is (937) 496-3181. Hours are Monday through Friday, 8:30 AM to 4:15 PM. The general court operates from 8:00 AM to 4:30 PM at (937) 225-4353, but the marriage license window has its own schedule.

Plan to get there no later than 4:00 PM. The application process takes time, and if you walk in at 4:10, the staff may not be able to help you that day. Online registration is available, which can cut down on how long you spend at the window. Both people must come in person under ORC 3101.05.

The Dayton and Montgomery County Public Health office at 117 S. Main Street handles birth and death certificates only. They cannot help with marriage licenses.

Dayton Marriage License Fees

The fee is $75.00. That puts Montgomery County at the higher end of the range among Ohio probate courts. Payment options include cash, money order, cashier's check, American Express, Discover, Mastercard, Visa, and debit cards. If you use a credit card, there is a convenience fee of 2.3% (minimum $2). Debit card transactions carry a $2.95 fee. ACH payments have a $0.50 fee.

Certified copies of a marriage record are $2.00 each. You can get them in person at the 2nd floor office, by mail using the Marriage License Certified Copy Order Form, or online with a credit card if the license was issued in Montgomery County and you know the exact marriage date.

This office does not issue marriage licenses. For that, you need the Probate Court on the 2nd floor.

What You Need for a Dayton Marriage License

Each person needs valid photo ID and a Social Security number. Driver's licenses, state ID cards, and passports are all fine. Your SSN goes on the application but is removed from any public copy of the record under ORC 3101.051.

If you were married before, a certified copy of the divorce decree is required. Widowed applicants need a death certificate. You must list previous spouses, minor children from those marriages, and the jurisdiction, date, and case number of each divorce. Under ORC 3101.05, each person swears to the truth of everything on the application. False statements count as falsification under ORC 2921.13.

Marriage License Rules in Dayton

No blood test. No waiting period. The license takes effect the moment the probate judge approves it. Ohio dropped its five-day waiting period in 2001. The license is valid for 60 days per ORC 3101.07. If you do not have the ceremony within that time, you need a new one.

After the wedding, the officiant must return the signed marriage certificate to the probate court within 30 days. ORC 3101.14 says failure to do this is a minor misdemeanor with a $50 fine. The court gives each couple an envelope for this purpose when they pick up the license.
